1.1 In this Contract:
“Works” means the electrical and ancillary works set out in the Quotation.
“Quotation” means the written quotation referenced above, including its scope of works, schedule of electrical points, materials, and total price, which is annexed to and incorporated into this Contract and forms part of it. A copy of the Quotation is attached at Annex B.
“First Fix” means the stage at which all cables have been installed, chasing of walls and floors is complete, all back boxes have been installed, and the property is substantially wired but not yet energised.
“Second Fix” means the stage at which all sockets, switches, faceplates, and accessories are installed and connected; the consumer unit is energised; plastering (where included on the Quotation) is complete; and the installation has been tested.
“Completion” means the date on which Second Fix is complete.
“Cert No. 3” means the Completion Certificate issued by Safe Electric for the Works under the Electricity Regulation Act 1999 (as amended).
“Working Day” means any day other than a Saturday, Sunday, or public holiday in Ireland.
2.1 GES shall carry out the Works as set out in the Quotation. The Quotation defines the scope of the Works exhaustively, including all electrical points, fittings, fuseboard specification, bonding, and ancillary items.
2.2 The Quotation takes precedence over any verbal discussions or representations. Any work not described in the Quotation is not included in the contract price and, if requested, will be treated as a Variation under clause 9.
2.3 GES will perform the Works with reasonable care and skill in accordance with current ETCI national wiring rules and Safe Electric guidelines.
3.1 The Customer acknowledges that a house rewire is a major construction activity. Even with reasonable care, the following disturbance is normal, expected, and unavoidable, and shall not be treated as damage attributable to GES:

4.1 Before the Works commence, the Customer shall:

4.3 Customer-supplied materials (e.g., light fittings, smart switches, EV chargers).
5.1 The Customer and any other occupants must vacate the Property for the entire duration of the Works.
5.2 The Property constitutes an active construction site during the Works. The Works produce dust, expose live or potentially live wiring, require periods with no power, involve lifted floors, open ceilings, and other hazards. Trained operatives wearing appropriate Personal Protective Equipment are required on site.
5.3 Should the Customer, or any person they permit to enter the Property (including family members, visitors, other tradespeople, or sub-tenants), remain in or visit the Property during the Works, they do so entirely at their own risk. GES accepts no liability for injury, loss, or damage suffered by any such person.
6.1 End-of-job cleaning is included: 16 cleaning hours in total (two operatives for eight hours), carried out on Completion.
6.2 Floorboards: GES will lift and refit all timber floorboards within the work scope.
6.3 Carpet and laminate flooring: GES will lift these where required but will not relay them. The Customer must arrange a flooring contractor.
6.4 Plastering: included only where explicitly listed on the Quotation. Where included, plastering is a making-good service that requires sanding and painting by the Customer afterwards; it is not a finished decorative surface.
6.5 Painting: never included.
6.6 Skip and waste removal: not included. The Customer is responsible for the removal of all waste arising from the Works.
7.1 The installation of mains-powered interlinked smoke and heat alarms is required under the Irish Building Regulations Part B (Fire Safety) for residential dwellings.
7.2 Where smoke or carbon monoxide alarms are included on the Quotation, GES will install them to comply with these regulations.
7.3 If the Customer instructs GES not to install smoke or CO alarms, the Customer accepts that this places the Property in non-compliance with the Building Regulations and that the resulting safety risk lies entirely with the Customer. GES strongly advises against this choice.
8.1 The Customer shall pay the Quotation Total in the following stages:

8.2 All payments shall be made by bank transfer to the GES business account, details of which appear on each invoice. Cash, cheque, and card payments are not accepted for these instalments.
8.3 All prices on the Quotation are stated inclusive of VAT at the reduced rate of 13.5% applicable to residential construction services in Ireland.
8.4 Parallel-stage works: depending on the property layout, the availability of plans, or other site conditions, GES may need to commence Second Fix works before First Fix is fully complete. In such cases, GES will invoice the milestone payments in proportion to the total works completed, rather than by strict stage. For example, when approximately 50% of total works are complete, the “First Fix” milestone shall be invoiced.
8.5 The Cert No. 3 Completion Certificate is not withheld pending final payment. Issuance of the certificate is processed through Safe Electric and ESB Networks, with typical lead times of two to three weeks following Completion. A soft copy of the certificate will be provided to the Customer when received by GES.
9.1 Any change to the scope of the Works after this Contract is signed is a “Variation”.
9.2 Minor Variations (those reasonably estimated by GES to cost less than €500): may proceed on the Customer’s written instruction (text or email confirmation is sufficient). They will be charged at €80 per operative per hour for labour, plus materials at cost plus 20%.
9.3 Major Variations (reasonably estimated by GES at €500 or more): GES will issue a written Variation Quotation which the Customer must accept in writing (email is sufficient) before the Variation works commence.
9.4 GES may invoice Variations either upfront or at the end of the Works, at GES’s reasonable discretion.
10.1 Each stage invoice is payable on the day the trigger event occurs. The Customer shall make payment without undue delay.
10.2 If any stage payment remains unpaid for more than 5 Working Days after its trigger date, GES may suspend further Works until payment is received.
10.3 If the Final stage payment remains unpaid 45 days after Completion, GES is entitled to charge interest on the outstanding sum at the rate of 1% per month (12% per annum), accruing daily, until the sum is paid in full. This rate is a genuine pre-estimate of the cost to GES of funding the outstanding balance and pursuing the debt.
10.4 GES may, in addition to interest, recover reasonable costs incurred in pursuing the debt, including referral to a debt-collection agency and Small Claims or District Court proceedings.
11.1 Where this Contract is signed at the Customer’s home or any place other than the GES business premises (an “off-premises contract”), or by distance means (online, by phone, or by email exchange), the Customer has a statutory right to cancel this Contract within 14 calendar days of signing it, without giving a reason and without incurring any cost beyond the cost of any Works carried out under clause 11.3.
11.2 To exercise the cooling-off right, the Customer must inform GES in writing within the 14-day period using the Cancellation Form attached at Annex A of this Contract, or by clear written statement (email is sufficient) sent to info@gormanelectrical.ie.
11.3 If the Customer expressly requests the Works to commence within the 14-day cooling-off period (see waiver tickbox on the signature page), the Customer remains entitled to cancel but, in the event of cancellation, must pay GES for all Works performed up to the point of cancellation, valued in proportion to the contract price.
11.4 GES shall refund all sums paid by the Customer (less any amount payable under 11.3) within 14 days of receiving the cancellation notice.
12.1 By the Customer, after the cooling-off period has expired (or has been waived under clause 11.3):
12.2 By GES: GES may terminate this Contract by written notice to the Customer if:
12.3 On termination by GES under 12.2, the Customer shall pay: all Works completed to date; all materials ordered for the Works; any sub-contractor cancellation fees; and a reasonable administration fee.
13.1 The Estimated Duration is approximately two weeks for a typical house rewire. The actual duration depends on property size, scope of the Works, site conditions, and other factors.
13.2 GES will use reasonable efforts to meet the Estimated Duration but does not guarantee it. Permitted reasons for delay include operative illness, family emergency, supplier failure, customer-driven scope changes, decisions awaited from the Customer, and unforeseen site conditions.
13.3 GES will keep the Customer informed of any material delay and provide a revised estimate.
14.1 If asbestos or any other hazardous material is suspected or discovered during the Works, GES will stop all Works immediately in the affected area.
14.2 The Customer must engage a licensed asbestos removal contractor at their own cost to inspect, test, and (if required) safely remove the material in accordance with the Safety, Health and Welfare at Work (Exposure to Asbestos) Regulations 2006 (S.I. No. 386 of 2006) as amended.
14.3 GES will re-quote the timeline, and where necessary the price, once the affected area has been declared safe by the licensed contractor in writing.
15.1 If the existing service cable or main tails do not comply with current ESB Networks requirements, additional works may be needed to upgrade them. These are “Cert No. 1 works”.
15.2 Cert No. 1 works involve ESB Networks directly. The Customer is responsible for: (a) liaising with ESB Networks; (b) paying all ESB Networks fees and charges; (c) accepting ESB Networks’ lead times. GES is not party to that arrangement and is not responsible for the timing, cost, or outcome of ESB Networks’ input.
16.1 On Completion, GES will submit the Cert No. 3 Completion Certificate to Safe Electric in accordance with the Electricity Regulation Act 1999 (as amended).
16.2 Safe Electric typically issues the certificate within two to three weeks, depending on its own and ESB Networks’ processing times. GES will provide a soft copy of the certificate to the Customer by email as soon as it is received.
16.3 The Cert No. 3 certifies the Works carried out under this Contract only. It is not a warranty or certification of pre-existing installations or works performed by others.
17.1 GES guarantees the labour element of the Works against defective workmanship for 2 years from the date of Completion.
17.2 Materials supplied by GES are covered by their respective manufacturers’ warranties only. The Customer should retain receipts and warranty documentation for these.
17.3 The guarantee at 17.1 does not cover:
17.4 Claims process: the Customer must report a suspected defect by phone (01 963 6636) or email (info@gormanelectrical.ie) within 14 days of becoming aware of it. GES will respond within 5 Working Days and, where the claim is covered by the guarantee, will rectify the defect at no charge.
17.5 If GES attends and the issue is not covered by the guarantee (for example, a Customer-supplied fitting has failed or a third party has interfered with the installation), GES will charge a call-out and labour rate of €80 per operative per hour.
17.6 The guarantee is non-transferable. It applies only to the original Customer named in this Contract and does not pass to subsequent owners of the Property.
18.1 GES carries Public Liability and Employers’ Liability insurance with a reputable Irish insurer. A copy of the current certificate of insurance is available to the Customer on written request.
19.1 GES may engage approved sub-contractors for ancillary works, including (but not limited to) plastering and cleaning.
19.2 GES remains responsible for the overall management and quality of the Works regardless of any sub-contracting arrangement.
20.1 Nothing in this Contract limits or excludes GES’s liability for: (a) death or personal injury caused by GES’s negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be lawfully limited or excluded under Irish law.
20.2 Subject to 20.1, GES’s total aggregate liability to the Customer under or in connection with this Contract, whether in contract, tort (including negligence), under statute, or otherwise, is limited to the Quotation Total paid by the Customer.
20.3 Subject to 20.1, GES shall not be liable for any indirect, consequential, or special loss, including loss of profit, loss of business, loss of enjoyment, or loss of opportunity.
21.1 Neither party is liable for any failure or delay in performing its obligations under this Contract to the extent caused by an event beyond its reasonable control, including (but not limited to): fire, flood, severe weather, pandemic, war, civil disturbance, industrial action, supplier failure, ESB Networks outage, or government action.
21.2 The affected party shall notify the other in writing as soon as reasonably practicable and shall use reasonable efforts to mitigate the effect of the event.
22.1 GES processes the Customer’s personal data (name, address, contact details, payment information, photographs of the Property where relevant) for the purpose of performing this Contract, providing customer service, complying with statutory record-keeping obligations, and the limited marketing purposes set out at clause 23.
22.2 The legal bases for processing are: (a) performance of this Contract; (b) compliance with legal obligations (e.g., Safe Electric record-keeping, Revenue Commissioners record-keeping); and (c) GES’s legitimate interest in marketing its completed works (subject to the Customer’s right to opt out at clause 23).
22.3 GES retains personal data for 7 years following Completion, to comply with statutory and insurance record-keeping requirements.
22.4 The Customer has the right to access, rectify, or request erasure of their personal data, and to lodge a complaint with the Data Protection Commission, all in accordance with the GES Privacy Policy available at gormanelectrical.ie/privacy-policy.
23.1 GES may photograph the completed electrical works at the Property for use in marketing, including the GES website, social media, project gallery, and case studies.
23.2 GES will photograph electrical installations and project details only. GES will not include in any published photograph: (a) the full Property address; (b) any exterior shot that uniquely identifies the Property; or (c) the names of any occupants.
23.3 The Customer may opt out of all photography by ticking the “Photography Opt-Out” box on the signature page. If the Customer opts out, no photographs of the Property will be used by GES for marketing.
23.4 If the Customer does not opt out but later wishes a specific photograph to be removed from a public-facing GES channel, they may request removal in writing and GES will comply within a reasonable time.
24.1 In the event of any dispute arising from this Contract, the parties shall first attempt to resolve the matter through good-faith discussion, in writing, within 21 days of either party notifying the other of the dispute.
24.2 If the dispute remains unresolved, the parties may by mutual agreement refer the dispute to mediation under the rules of the Mediators’ Institute of Ireland.
24.3 Failing resolution, either party may bring proceedings:
24.4 This Contract is governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction to settle any dispute arising under it.
25.1 Any notice under this Contract must be in writing and may be served by:
25.2 A notice sent by email is deemed delivered on the next Working Day. A notice sent by post is deemed delivered three Working Days after posting.
26.1 This Contract, together with the Quotation referenced on page 1, constitutes the entire agreement between the parties and supersedes any prior written or verbal representations, proposals, or agreements.
26.2 If any provision of this Contract is held by a court to be invalid, unenforceable, or unlawful, the remaining provisions shall continue in full force and effect.
26.3 No variation of this Contract is effective unless it is in writing and signed by both parties (email confirmation by both parties is sufficient for variations valued at less than €500; written quotation acceptance is required for higher-value variations as set out at clause 9.3).
The Quotation referenced at clause 1.1 forms part of this Contract.

By signing this Contract, the Customer confirms they have read and understood every clause, and confirms the following acknowledgements by ticking the relevant boxes:
(a) Cosmetic Disturbance. I have read and accept clause 3 (Expected Cosmetic Disturbance). I understand that walls, ceilings, floors, skirting, tiling, and cornicing may be affected, and that GES is not responsible for these effects within the scope described.
(b) Vacate the Property. I have read and accept clause 5. I understand that the Property must be vacated for the duration of the Works and that any person who remains or visits does so at their own risk.
(c) Hidden Services Disclosure. I have disclosed to GES, to the best of my knowledge, all known hidden services (gas pipes, water pipes, alarm and network cabling) at the Property, and any known asbestos-containing materials. I understand that GES is not liable for damage to undisclosed services or for delay caused by the discovery of undisclosed asbestos.
(d) Photography Opt-Out. (Optional — tick only if you wish to opt out.) I do not consent to GES photographing the completed Works for marketing purposes.
(e) Cooling-Off Waiver — Short-Notice Start. (Optional — tick only if the Works are to begin within 14 days of signature.) I expressly request that the Works commence within the 14-day statutory cooling-off period. I understand that by doing so I lose my statutory right to cancel free of charge, but I may still cancel — in which case I shall pay GES for any Works completed up to the point of cancellation.
